Question on film copyrights

I was wondering if anyone knew where i would stand regarding casting one of my sculpts which is taken from a character in a film,do the film company own the copyright over the character which would prevent me from casting and selling the item?Just wondering if anyone sould throw some light on the subject.
Here is the piece in question `Kruger` from the film Cross Of Iron.

I believe there is some skirting of the issue regarding a release of 'a barbarian' without calling it Conan, etc. but ultimately all rights belong to the filmmakers and/or distributors. Some film companies or older films probably wouldn't care and it may even promote the film, but that's certainly their call. Whether they'd react of even be interested in action depends on a lot of things.

That being said, do you think George Lucas would be upset if you sold Darth Vader kits? I bet you'd have a team of lawyers on your doorstep in no time.
