I know the difference in the insignias (I have been painting civil war figures since the 80s), but honestly, I can't see the insignia on the figure clearly enough, it looks like the wing of an eagle to me. That said, given the uniform, the guy could be anything from a 2nd Lt on up.Shoulder straps. The rank insignia for a colonel is an eagle. The shoulder straps (epaulets) on the figure are bare, indicating the guy is a second lieutenant.
I am terrible about nitpicky details, and this minor thing in no way detracts from this figure. With a little inspired detail work on the straps he can be any grade of officer. So far as I know this is the fourth figure in this series and I intend to own them all. Good question Matt.

We will have to agree to disagree on the boxart here Steve. Awesome figure though and like the rest of the line on my must have list.The rank device is centered on the shoulder strap; those are bare. 2LT he is. Poor guy.
