So I had an interesting weekend... but I'll get to that in a minute, first a little background. I was attending the NOVA Open show in the DC area. It's primarily a gaming convention but for the past two years they've also been running a painting competition called the Capital Palette. They've teamed up with some great sponsors including Secret Weapon Miniatures and Grex Airbrushes, so even though its a relatively new show they've got some very nice prizes. They've also worked with Cool Mini to make it a Crystal Brush qualifying event, so best in show gets a free trip to Adepticon to enter into the Crystal Brush painting competition in Chicago. They also organized a bunch of painting seminars, I took one on airbrushing and another on weathering with pigments and I wish I'd signed up for more. All in all, it was a really great show and I hope to attend again next year. However, the weekend had one unfortunate incident...

It's a multi-day show, so I dropped off my figures on Saturday but final judging and awards weren't until Sunday. All figures are displayed in a number of locked cabinets and display cases, so you'd think things would be pretty secure. Unfortunately, because the show is at a hotel, they are not the only event going on. There was a wedding Saturday evening and one of the guests got a little out of hand. Around 12:40 am, according to the incident report, a group of people were either trying to calm a guest down or escort him out. As they were passing by the display area he broke free and tore down one of the NOVA Open banners. They restrained him but he broke free again and this time attempted to knock over one of the cases. While he did not tip it over completely, he did slam it into a column hard enough to knock out a chunk of cement and damage a number of the figures, five of which were mine. Below you can see some of the damage although the pictures don't show everything. There are also numerous chips and cracks, the bond between the rider and the horse was broken, the gladiator's right left is split and the aquilifer is barely attached to the base. I also had another two figures damaged... but you get the idea.

To make a long story short, security got involved, a police report was filed, and I've been told the family will compensate me for the damages... though saying they will and actually following through are two different things.

Despite all that, the day did end well. I picked up gold medals in two of the categories and my goalie figure won best in show. I thought the NOVA staff were very helpful in dealing with the whole incident and are still offering whatever help they can in dealing with the family. It's also helping them make the argument to the hotel that they need a more secure area to store the figures next year.

I think most of us know that alcohol and miniatures don't mix. But throw in an angry wedding guest and you've really got a problem!

What a bell end I hope he got a good kicking too, hopefully it doesn't look too bad the damage and fixable
Steve

Hi David,
Sorry to hear about such fine models getting damaged:(, make sure you get adequately compensated I can see $2,500 worth of write off just in those three photo's, make sure you hit them hard and don't settle for a pittance. Failing that a name and address of the culprit would suffice!
cheers
Richie

Thanks, Steve and Richie. Yeah, it was a little hard to take when I saw my Lancer was both decapitated and dismembered!

What I assume is the guy's father contacted the hotel, he seemed very apologetic and offered to pay for the damages. He said he wanted to deal with me directly so I gave him a call and sent him a list of the figures and what their value was (as calculated by one of the show judges, not me). He ended up calling the hotel back instead of me and offered 1/3 that. So, looks like this is going to be a little more complicated. Unfortunately I don't know of a way to get miniatures appraised. The best thing I can come up with is to have the show judges put in writing what the figures are worth, what they would sell for to a collector. I'm certainly open to any advice or suggestions anyone else might have.

Typical "I'll pay, oh now I don't want to" I hope you nail him for everything I would suggest the judges and maybe some painted figures off eBay etc or chat to some of the pro painters here and see what they#d charge for similar figures
Steve

No surprise there David. The only people who understand the real value of a finished piece are either other modelers and painters or dedicated collectors.
The guy probably thinks you're trying to rip him off for what he probably regards as 'toys'
Suspect you're in for a rocky ride.
Good Luck
Derek

Jeez mate that gladiator took a real knock...look at the blood pouring out of him!
I always walk away from my figures on the Saturday at a competition with some trepidation, thinking that some twat would steal or damage them.

Regarding the payment.....settle for what you think is a good price not what others think. The guys father actually chasing you to make amends means he's a genuine guy. I would give yourself an hourly rate and roughly calculate how many hours you spent on them and add to the cost what you think for the materials. You've won awards so obviously they are a good standard. Dels' right though, most peeps will look upon them as toys and ornaments and will not see the value in your babies. Perhaps some negotiation telling him the amount of work that went into them will help. Failing that you can always try Citizens advice to give guidance on a small claims court and then suggest this to the father if you can't reach a settlement. Failing that, I can put you in touch with a couple of knuckle draggers who will bludgeon the drunken twat for some whisky shortcake and Ravioli....(Del, Ron.... tool up, I might have a job on for you!)

Congrats on the awards by the way...excellent.

Get a few appraisels and don't back down if he baulks
Failing that... "an eye for an eye" or broken figure arm=broken real arm:blackeye: ... he'll probably cough up before you get to equating the decapitated Lancer:dead:
The lack of respect for other peoples stuff is painfully lacking in today's society... bad enough this drunken goof willfully destroyed your hard work, even worse is that he or his family won't make things right... Makes me sad:( and furious:mad:

Good luck... I wish I was close enough to be able to help

Colin

You're a better man than me. I would have just taken it out of the guilty party's arse then and there. If the guy was bigger than me, then a tire iron usually does the trick...

Seriously, sorry to see that sort of thing happen anywhere these days.

not only do i paint figures but i am an avid collector of them.. Especially russian made ones.. Some costing way more than some people think. I have hundreds of them.
Any foot 54mm figure will run between 150 and 500$ US for the top of the top, worth winning a medal
Any mounted 54mm figure will cost no less than 400$ US and can reach easily a thousand $ with the average napoleonic figure around 500$.
So in my book, you have close to a thousand $ in those three figures depicted in the pictures.
I would be so pissed.... I mean.... Come one... Are people that stupid ?

Colin, I think you should start contracting your services out mate! You can start with security for our local West Australian show this month... ;)

David, I'm really sorry to hear about your figures. They are brilliant and I've admired them in your previous PF posts.

Congratulations on the gold medals and best in show, and I hope it all works out well for you. Good luck mate.

I would approach this differently. I figure the more time passes the less likely you are to get anything. It's no surprise that a lay person would not expect the figs to be worth what they are. Also the figs are damaged, not destroyed so maybe you should be trying to recover repair costs. I would take the third and settle. Then get down to fixing them.

Colin

:LOL:I'm afraid I'm getting far too old for that kind of fun... I could hand out some frightening threats with my cane though :sour: That's my past seeping through again.
Mind you, I still have friends in low places ;)

The offer of a third of what the judges suggested is not that bad...hiring a lawyer will immediately take a third, plus any extra expenses, off the settlement , which may not be as high as you'd like. Then there will be the time (plan on waiting a year or more) and other expenses if you have to go to court. If there wasn't a set price on them, the court could look at them and base the settlement of replacement of the unpainted figure at retail, of which, again, the lawyer gets a third off the top. Even small claims might be a costly challenge. You have to be present for each hearing. Here, the defendant gets to blow off the court three times before he defaults. You'd have to go after the drunk and he might be even less able to pay than his father.

He's right. It may be best to take the 1/3 and walk away from this. Civil cases can drag out for years. I tried to get my collection appraised some time ago by a large insurance company and the best they could do was list it under, "toys and such" Its the same in Pennsylvania. The law seems to be on the side of the suspect because heaven forbid we deny him/her their rights and discard the victim's. Hopefully street justice will prevail on this clown sometime in the future and when he gets drunk and stupid again, someone will cause the need for some repair work on him.

This is a crying shame. I hate to see any finished pieces damaged even by accident let alone like this.
I would dread my finished pieces ending up like this, I think it would probably be the end of my painting days as each one holds a specific goal and is a reference to improve on the next.
Only a suggestion and obviously this depends on how attached these specific pieces are.
The other option I see would be to ask for the full price but he then takes ownership of the pieces, a bit like if you drop a tea pot where all breakages need to be paid for sort of thing.
You are a superb painter but this was just an idea in case you did not feel like revisiting the pieces.
I the father does not want to pay can it not be reported legally as an act of vandalism.
Just an idea and you have probably thought of this.
I hope it resolves in YOUR favour
Best wishes
