Here goes, this is just one of the unscrupulous that is thieving from our hobby.
Feel free to give a call or do anything to disrupt this individual. It wouldn't hurt to be posted on as many forums as possible, the number is probably false of course but it is some info

Updated details above to add sellers email, which I believe is his PayPal so I can report selling of illegal goods , not sure if it will do anything though
 
Interesting, I hope you get him closed down Gra, I suspect he'll start again but if you (with the help of the painting community) annoy him enough he'll lose interest and go away.

The number of his sales is staggering, despite the fact that he's sold lots of the same figure (whilst claiming that they are from his collection) he's getting rave reviews and repeat customers.

Fortunately, I'm too small fry for these guys (touch wood) so I've not been affected (yet, or that I know of), but really feel for the guys that have been hit. I know how much I've put in to Tommy's War financially and emotionally and to see that being chipped away by thieves must be heart breaking. I can't say how I'd feel if I saw my range recast, I guess I'd be close to packing it all in. I know there have been a few pointers at figure companies 'crying', but let me say categorically that I know most of the figure manufacturers fairly well and none of them are making vast profits (if they are, then they are hiding it well). From my perspective I work full time, I couldn't draw a salary from Tommy's War and sustain the cash flow required to grow the business. Indeed, in 4 years of Tommy's War I've not taken a single penny out of the business, that's in spite of working 20 hours a week on the business - on top of a full time job where I regularly have to put in 12 hour days!

As for the Tony Wilbraham message? Well, I read that last night agog. In the interests in decency I'll keep my thoughts on the man to myself, but overall his sentiment reminds me of people who defraud insurance companies claiming 'everyone is at it', or that 'they make plenty of money' - it doesn't stop it being a crime.
 
Has anyone contacted any of the other manufacturers whose items he's selling? Spreading the word through the community is good, we can now avoid him, but you copyright holders are the ones with real standing to do anything to stop him.
 
You can get a good result if you complain to Pay-Pal. I did this, with the full knowledge of the manufacturer and successfully got the offender removed from E-bay AND deprived him of the recast, AND got my money back!!! E-bay is reluctant to take any action, BUT pay-pal deal only with money, so are much more aware that to operate they need to have a degree of trust with their customers. I picked a target, one "Artstudiojean in Poland, and ordered a figure( WHICH HE USED THE BOXART TO ADVERTISE) When the figure arrived, I phoned Pay-pal's customer service line, and told them that what I had received, was a fake, and NOT WAS ADVERTISED on the site. I went further and said this was a scam, and I want my money back!!! which they did, AND his Pay-Pal Account was revoked, and eventually he lost his e-bay site. Now, I'm not niaeve enough to see this as a cure, BUT, it sure as hell makes it much more difficult for these guys to operate as easily as they do right now. SO, here's where PF can make a positive contribution, Imagine if not just 1 person did this, BUT 20-30 PEOPLE DID IT AT THE SAME TIME to the same recaster. He end up with NO money NO figures all those postal fees and NO site. SO Cmon put your money on the line if you REALLY care about this problem. Ray Stout

Cheers Ray, that is a great help as I ordered a product so I could get access to his details and exactly for the reason you mentioned, to get a foot in the door with paypal. It also enables me to publicly give neg feedback. I explained in another thread but of course if I do receive anything, which I should as I have paid, that will be going straight to said manufacturer so hopefully they can get the ball rolling. My aim is to really cause as much distruption as possible and for him to be out of pocket and ideally as you say Ray, if I can get his paypal stopped even better. I agree it's not the end of it sadly, but it makes me feel a hell of a lot better even if it is only a little battle one. Lots of those may make these scumbags think twice. I got an email from him today saying he will not list anymore of my products, we will see. It's not just about me of course, I will keep this thread updated. Thanks for your support everyone

Once you know personal details, I would also send a company letter ( as a director, not just you as individual) to his local police department, (may be even national fraud/counterfeit unit) to alert them to criminal activity + evidence. Whether it will do something or not, I would do it regardless. If enough people do it, they will be forced to acknowledge it. And then follow up with a letter few month later to inquire what action was taken.

He will say he will withdraw it ...he is a liar and a thief so his word is worthless. You just wont be able to see it as he wont sell to uk so it wont show up in a search on ebay...you cant see what you cant buy.

I have seen this guys feedback and my kits and steves from sk are selling well it seams with great reviews.

Does anybody know an address for his local police station !!!

Mark - what I suggested is an official company letter to a Police representative of a fellow European state to alert them about criminal activity in their jurisdiction.
Its not demanding action, its reporting a crime. And a copy of the letter to a national fraud unit in Warsaw (whatever the name may be).

If some result is expected, no point doing half measures.

I am not saying to ring them, this will be futile and waste of their time. If I rang them it would be to ask about their procedures or specific person to deal with.

No one will send the squads, its not Hollywood. But the guy will be on their radar. Its up to them what they do with it. Even if they came and knocked on the door to ask questions may make ones bum twitch just a little.
 
I'm sorry to maybe be a little too cynical but considering what other ******** most Police have to deal with I can't see recasters as being a priority police matter for any local police anywhere.
Just forget the local police angle and go to the agencies that deal with this crap, and hit Paypal hard, copyright lawyers and consumer and fair trading law enforcing agencies.
 
I agree. Its may be very unlikely that they will pay attention.

But as I understand, the guys want to utilize every opportunity - and this is one. Like I say, one letter may not do it, but letters from several companies may.
 
Ok. Lets put it this way. I refrained from getting involved into discussion so far but here are my 5 cents.

1. Pursue definitive legal action. I know its daunting and costly
Poland is a European state. Therefore its legislative base is sound (ish) + European law back up. You have a huge chance of success compared to somewhere in Thailand or China
I think it will be reasonable and high chance of success to take the re caster to local court. I certainly would.
It will cost initially, but the damages and costs will be recovered from recaster. Stu has evidence of his business, product, and master copy. Recaster will not have that.
All it needs is a consultation with local solicitor, willing to take on the case.
I am aware of a successful case in Russia, if they can do it, Poland is a doddle.

2. Disrupt their network - like mentioned before - ebay, paypal, any official channel / company on the way, report report report. Within reason, however , not to become a buzzing nuisance fly.

3. Disrupt their communication - a soft thing, but may help. Waste their time asking questions about products, negative feedback's, spam their emails so they are forced to change them. This required time, but whole community can do this.
It is similar to 419 scambaiting, just annoy them as much as possible without crossing into domain of harassment

I do not have a full address only as posted above. On more research on the phone number it is linked to another business so I suspect a fake, I am emailing the company with the phone number.
To be honest court action is out of the question, there is just no way I can fund such a venture even up front, and as said, I don't even have his full details. I do think that the police option may be worthwhile, if nothing else to get off my chest and even if the remotest possibility of them looking at it to me is worth it, but as said, it is probably a very very long shot.
I am reporting to PayPal and believe me, I will be causing as much nause as possible.

I don't want to appear negative but as very small players in a big pond are we really going to spend our time chasing these guys will there be any time left for painting?

I've just been looking at a guy on Ebay from Hungary.............he is selling a variety of recasts and judging by the feedback the quality is good.

He joined Ebay in August 2013.............he has 154 Followers with a feedback rating of 99.5%
Last Month Feedback 114...........3 months 498..............12 months 621.

He has a substantial business and all of the posts on PF are not going to make him go away....I wish you luck guys but these people are prospering in difficult times mainly in emerging economies. With the world financial situation as it is they are going to make money one way or another.

I fear it is going to take a lot more than a few mails to prevent this erosion of our hobby sad as it is. Maybe some concerted effort sponsored by one of the Majors like Pegaso and supported by many of the producers who post on here would have more clout with Ebay?
